Abstract

Objectives. The article is aimed to ground legislative differentiation of legal regulation of em-ployment relationship creation with women by providing them with benefits and advantages, and also to offer suggestions in the field of further improvement of the legal regulation of women employment with-in a market economy for the sequel improvement of their social and labour guarantees. Methods. The research of legislative differentiation of legal regulation of women employ-ment within a market economy is conducted. Directions for further labour legislation reformation in the field of legal regulation of women employment are analysed and grounded. Results. The conclusion is grounded, that market economy formation and in this regard cre-ation of various enterprises and organizations which are based on the different forms of ownership, changing of the state participation in the scope of social and labour relations regulation deter-mined the necessity of the development of more flexible and optimal system of women legal protection in the area of engagement and employment. It is suggested to establish conditions at the legis-lative level by which female labour can be economically advantageous for both women and em-ployers. Scientific originality. It is stated that in spite of technical women protection in the field of occupancy, the problem of their employment in modern socio-economic conditions remains very actual and must be immediately solved by introduction of amendments to national labour legisla-tion. The suggestions of flexible policy of providing women with benefits and advantages in the field of the employment relationship creation are grounded. Practical value. The practical significance of the article lies in that the formulated sugges-tions can be used for preparation of the new Ukrainian Labour Code and other statutory instru-ments which provide gender equality in the field of employment relationship creation with female candidate for employment.
