RECONSTRUCTION AND REFORMULATION ISLAMIC LAW REFORM PERSPECTIVE JAMÂL AL-BANNA

The idea of this update is a reflection of the socio-political and cultural conditions as well as intellectuals in the Islamic world far behind from other nations, especially the west. This paper discusses the basic thoughts of Jamâl al-Banna in efforts to reform Islamic law, using the method of literature by al-Banna, Nahwa Fiqh Jadid.The concept offered by Jamâl within the framework of Islamic legal reform is to ‘operate' sources of Islamic law in a way to reconstruct and reformulate the conventional understanding and traditionally the source material in understanding the sources of Islamic law and replace it witha new formulation. According to him, the source of Islamic law; reason,universal values of the Qur'an, the Sunnah, and customs (‘urf).
