Abstract
In this article the issues of formation and functioning of innovative industrial clusters in Russia, in particular the mechanism of their formation, are considered, the normative and non-normative documents devoted to the clustering process are also analyzed. The need of processing and the further development of the legislation regulating activity of clusters, legal relations in a cluster and determining an order of their formation is proved.
