Abstract
The article considers the conditions for the return of the criminal case to the prosecutor. The author analyzes the provisions of the Code of Criminal Procedure of the Russian Federation, the resolution of the Plenum of the Supreme Court of the Russian Federation, and conducts an analysis of law enforcement practice.
