COMPARATIVE LEGAL CHARACTERISTICS OF THE SEARCH AND ITS PROCEEDINGS IN RUSSIAN AND GERMAN CRIMINAL PRACTICE

The article analyzes the Criminal Procedural Codes provisions of the Russian Federation and the Fed- eral Republic of Germany regulating the conducting of such investigative action as a search. The definitions of the «search" concept, presented in Russian and German criminal procedural legislation, are compared. The rea- sons for conducting the search are considered, similarities and differences in relation to determining the status of the subject who was searched are revealed. Search of dwelling is characterized, a comparative analysis of this investigative action membership, as well as the notion of «urgent cases «is given. Recommendations for improv- ing the norms of the Russian Federation Criminal Procedure Code are proposed
