SOME PROBLEMATIC ISSUES AS FOR IMPLEMENTATION OF PENITENTIARY FUNCTION BY THE MINISTRY OF JUSTICE OF UKRAINE

Problematic issues as for implementation of penitentiary function by the Ministry of Justice of Ukraine are revealed in the article. The purposes and tasks of the strategy of the system of execution of punishments reforming are analyzed. The reform of the Penitentiary System is a current and rather complex problem today, and its solution requires a considerable amount of time and a comprehensive approach. And in this regard, the key issue should be legislative definition of the legal status of the SCES of Ukraine not only at the national level, but at the regional as well. A number of key issues concerning the implementation of penitentiary function by the Ministry of Justice of Ukraine remain unclear today. That is why, based on the identification of objective and subjective reasons that negatively affect the development of the ideas of penitentiary activity and penitentiary government, as well as the application of the principles of penitentiary administration, the problematic issues related to the implementation of the penitentiary function by the Ministry of Justice of Ukraine and the ways of their solution are identified. The concept of our vision of the Penal Service is in the widespread application of penitentiary administrative principles, which should become the basis of qualitative governance in this area. Author's definition of the concept «penitentiary activity» in broad and narrow meaning, as well as author's understanding of the concept «penitentiary administration» is proposed. Attention is drawn to the necessity of forming a Penitentiary Service that would exist in the status of an independent service (agency, bureau), would be coordinated by the Minister of Justice and would be able to be responsible for the development and implementation of penitentiary policy of Ukraine independently.
