TO THE QUESTION ABOUT SUBJECTS OF EDUCATIONAL LEGAL RELATIONS

The creation of a modern highly effective education system in Ukraine is one of the most important conditions for the competitiveness of the state in the European market. In this regard, a big role should be assigned to pre-school education. The article highlights certain legal categories relating to the subject composition of educational relations. The normative legal acts regulating the issues of education and activities of preschool educational institutions as participants of educational legal relations are analyzed. The problem questions of functioning and the legal status of separate subjects of educational legal relations are revealed. According to the law of Ukraine "on pre-school education" form of ownership of pre-school education is determined in accordance with the law and can be as state, municipal and private. Pre-school education institutions may be based on the principles of public-private partnership (corporate pre-school education institution). Need to be resolved by way of agreement, clause 4 of the Regulation, which defines the constituent document of a preschool institution - only the Charter, and paragraph 29 regarding the possibility of not feeding children in a preschool educational institution. However, the activity of a preschool institution on the basis of public-private partnership (corporate institution of preschool education) is possible, in accordance with the Law of Ukraine "On Public-Private Partnership" (Article 5) and Chapter 77 of the Civil Code of Ukraine on the basis of the agreement on joint activity, property management and concessions. Regarding nutrition - Sanitary regulations for pre-school education, establishes that the founders (owners) and the heads of these institutions must ensure the implementation of the Instructions on the organization of food for children in pre-school, which establishes other time intervals for feeding children. The ways of improving the legal regulation of this issue are proposed.
