Abstract

This article deals with the issue of adolescents in conflict with the law, who are traversing the social context marked by stigmatizing and degrading titles. However, there is the right to education, as a possible change of this reality, from the educational improvement in the socioeducational centers, contributing to the re-education and reintegration of these offending adolescents in society. The admission is a socio-educational measure involving deprivation of liberty, applied in socio-educational centers and subject to the principles governing socio-educational care, especially those of brevity, exceptionality and respect to the inherent condition of the adolescnet as a developing person. This work deals with the legislation pertinent to the topic and prolematizes the guarantee of the right to education to the adolescent offender, the subject of debates among scholars since the promulgation of the Statute of the Child and Adolescent int the year 1990. The analysis will be on the socioeducative measure of deprivation of liberty, which should have a pedagogical and non-punitive approach, according to the premises of the NAtional System of Socio-educational Assistance - SINASE. The text also addresses the right to education as part of an integrality of priority public policies, aimed at adolescents who find their rights violated as soon as tehy are protected by the State.
