How to Prevent Drug Smuggling

Abstract

The Criminalization and criminal treatment of the criminals by the government, are the most prominent form of dealing with the crimes and the criminals. For this reason, the first applications of the criminal policy have been determined in a sense equivalent to criminal law or criminal justice system based on crime, punishment and law. One of the cases in which the anticipated criminal policies could be examined, is the smuggling of counterfeit drugs, and some question will arise, including “What is Iran's criminal policy for the smuggling of counterfeit drugs?” And is the said criminal policy responsible for ensuring the implementation, reduction and prevention of drug smuggling crimes? One of the most important ways of dealing with these crimes, including smuggling of counterfeit drugs, is to prevent them occurring in different ways, which can be categorized as criminal preventions (repression and execution of punishment) and non-criminal prevention (social prevention and situational prevention). The crime of smuggling has been deeply rooted in the depths of the societies due to its great background and significant revenues, and to eradicate this crime, there is a need for robust, deliberate and targeted plans for prevention, which can be more effective than the punishments. Specifically, in order to prevent smuggling of goods in general and smuggling counterfeit drugs in particular, some methods can be considered, including: the VAT plan in preventing economic corruption and smuggling of goods; targeted, planned and limited imposition of the rates of customs duties; revision of the Border Markets Policy as a refuge for smuggling of the goods; and revision of the policy of creating employment and income in the border areas.
