THE PROBLEM OF ADDITIONALITY OF ARTICLES 263-1 AND 270-1 IN THE CRIMINAL CODE OF UKRAINE

The opposite approaches of the researches to solving the necessity the articles 270-1 and 263-1 in the Criminal Code of Ukraine have been analyzed. The number of essential drawbacks characterizing the legislator's actions including the norms of the articles 270-1 in the Criminal Code of Ukraine has been outlined. The content of the articles 263 and 263-1 of the Criminal Code of Ukraine have been analyzed, taking into account the uniform of the acts specified therein. The negative consequences that in connection with the norm of the article 263-1 in the Criminal Code of Ukraine have been mentioned. The judicial practice in the field of qualification of the actions provided for by the mentioned articles has been investigated and the difficulties which arise when applying criminal law data in practice are clarified. The author's own point of view on this problem has been written.
