About the restriction of the criminals for crimes provided by art. 107 and p. 4 art. 111 of the criminal code

This article presents an analysis of the study of murder, which is committed in a state of passion. In practice quite often there is a problem in law enforcement agencies with qualification of the considered article of the criminal code and with its delimitation from adjacent structures, in particular: from h. 4 of Art. 111 of the criminal code (the deliberate causing of serious harm to health which entailed on imprudence death of the victim). This problem is poorly understood, which requires further scientific study.
