Digitization of the Cultural Heritage Objects in Accordance with the European Union Copyright and Related Rights Legislation

The purpose of the work is the research of tendencies of development of copyright and related EU rights in the conditions of formation of information society, modernization of its norms under the infl uence of widespread distribution and application of the latest digital technologies in life activity of the modern European society, increasingly their active implementation in the fi elds of culture and cultural heritage are. To achieve this goal, the sources of copyright and related rights, their role in the formation of a system of protection of creative and intellectual activities, harmonization and unifi cation of the legislation of EU member states are analyzed. The main attention is paid to acts of secondary law, in particular, in the form of directives and recommendations that have long-term signifi cance for building a legal basis for digitization of cultural heritage objects covered by EU copyright and related rights, to address users' access to legitimate digital content. The methodology of research of the article is based on the complex application of general scientifi c methods (historical, logical, systemic, structuralfunctional, of classifi cation, logical-semantic) and special-scientifi c methods (of defi nitive analysis, source analysis and synthesis). Scientifi c novelty, according to the limited study by Ukrainian archival science of this topic, is to outline the specifi cs of modern legislative practice in the fi eld of copyright and related rights of the EU, which is characterized by strengthening the regime of legal protection in the interests of creators and owners of intellectual products, fi nding ways to reconcile private and public interests, optimal legal solutions and mechanisms to ensure full access of EU citizens to information, knowledge, digital content of cultural heritage in all the richness of its species composition. The conclusions substantiate the need to study the European experience for the development and implementation of projects, programs for digitization and creation of integrated digital resources of the archival heritage of Ukraine, its presentation in world information networks.
