ENSURING THE RIGHTS OF PERSONS HELD IN TEMPORARY CUSTODY ACCORDING TO ADMINISTRATIVE PROCEDURE UNDER VIETNAMESE LAWS

Temporary custody directly affects the basic citizenship of the detained persons, restricting their physical freedom for a given time and temporarily isolating them from society. Therefore, ensuring the rights of the persons subject to this measure is significantly important not only for enhancing the power of the laws but also limiting the infringement of the detained persons' legitimate rights. This article analyzes the present regulations on temporary detention or custody according to administrative procedure, outlines the current legal situation and proposes some recommendations for completion and strict and lawful application of this measure in Vietnam.
