THEORETICAL AND LEGAL ASPECTS OF THE DEVELOPMENT OF DIGITAL ECONOMY IN UKRAINE

The article is devoted to the research of problems and prospects of development of digital economy in Ukraine and to finding out the main ways of solving these problems, as well as processes for accelerating the full implementation of digital economy in real life. The authors analyze the main directions of digital technology penetration in the fields of law on the basis of the use of general scientific and special legal methods, as well as theoretical and legal issues of ensuring their use in the Ukrainian economy. In the course of the research attention is focused on the study of the essence and content of the concept of digital economy, the importance of this category under the current conditions of transformation of the economic foundations of society, its influence on globalization transformation of the world in general, as well as consideration of the components of law, which undergo changes in terms of digitization of economic and community life. As a result of scientific research, it is determined that digital economy is a set of economic, political, social and cultural relations that arise in the process of using digital information and communication technologies. The need of rethinking of the concept, content and structure of law, which dynamically evolve due to the expansion of the information space and the introduction of the latest technologies; determination of the vector of development of the mechanism of legal regulation of various aspects of the legal status of subjects of law, legal regime of objects of law in digital space and virtual legal relations is also proved. Digital economy as an integral part of the information society requires appropriate legal regulation, which should first of all be ensured by an act of small codification — the Law on Digital/Electronic Economy. This will not only correspond to the Basic Principles of the Information Society Development in Ukraine, but also will give participants of digital economy relations more opportunities for the implementation of their rights and interests, and at the same time — their protection in case of violation.
