DEFINITION OF THE LEGAL CATEGORY «RIGHTS OF WAR VETERANS AND PARTICIPANTS OF BATTLE ACTIONS»

The category «fundamental rights of war veterans and combatants» through the prism of the category «basic human rights» has been studied. The basic concepts of understanding (in particular, positivist and natural law) of human rights are considered. It has been determined that discussions are still underway in the scientific community about approaches to regulate human rights. It is pointed out that at the present stage of the development of philosophy and theory of law, positions regarding the consideration of fundamental rights in the context of the natural concept of legal thinking are prevailing. Scientific approaches to the definition of «human rights» are analyzed. The signs of fundamental human rights are highlighted. Based on the research, the author's vision of the category «fundamental rights of war veterans and combatants» was formed.
