CLASSIFICATION OF EDUCATION SERVICES IN CASE OF COMMERCIAL LEGAL REGULATION OF THEIR PROVIDING

Abstract

The article examines the types of education services through the prism of scientific approaches to their definition, as well as modern legislation of Ukraine, which regulate commercial relations in education services providing. The author systematizes and concretizes the basis for classification of education services in order to increase the efficiency of commercial law regulation of these services, improve their quality and competitiveness in the market, put forward adequate conditions for their provision, clear commercial law regulation between customers and education services providers. The article highlights the defining features of education services, such as their intangible nature, forms of education, the inability to guarantee the usefulness of the result of the service providing, the professional status of the subject of education services and uncertainty of approaches to taxation of such entities. Thus, the article reveals the specifics of education services, which should contribute to the improvement of their commercial law regulation. In addition to the characteristics of payment or free of education services providing, the author proposes to allocate «conditionally free» education services due to legislative conditions or pre-defined conditions in the contract. The article stipulates that education services should be classified on various basis, which are selected depending on the purpose of the classification. As a result of this research, the author proposed a grouping of the basis for the classification of education services. The first group should include the proposed by scientists basis for the classification of services as such, in particular: functional approach and scope of services; type of needs; result; the nature of the actions, the professionalism of the subject. Using these grounds, it is specified that educational services are public, basic, intangible, factual, professional. The second group is proposed to include basis that take into account the peculiarities of education services and allow their division into types. Such basis are the entity receiving the service; term of granting; payment for the service; components and levels of education; form of education; orientation of services; specialization of services.
