MODERN PERIOD OF FORMING THE SYSTEM FOR THE PREVENTION OF CRIMES COMMITTING BY PUBLIC SERVANTS

The article analyzes the modern period of forming the system for the prevention of crimes committing by public servants. It is noted that the modern period (from 1991 to the present) took into account the positive achievements of previous periods, which according to the results of the author's historical and legal search include: 1) the ancient period — from the formation of states in the Ancient world to the formation on the territory of modern Ukraine the first centralized state formation — Kyiv Rus (IX century); 2) the pre-revolutionary period (before 1917); 3) the period of Ukrainian state formation (1917–1921); 4) the Soviet period (1922–1991). It was found that the socio-legal significance of the sources for criminological (and in particular anti-corruption) policy in the sphere of public service is that they: firstly, highlight the key issues that existed in retrospect or exist today in the sphere of public service (these problems are an institutional determinants of crimes committing by public servants) and need to be solved; secondly, identify the main ways and means of solving existing problems, outline priority areas for further development of the public service (relevant areas, ways and means are part of the general social level for the prevention of crimes committing by public servants). It is concluded that, since Ukraine's independence, there has been a transformation of approaches to both the fundamental principles of the public service and the settlement of the principles of criminal-law and anti-corruption policy for the prevention of crimes committing by public servants. Proposals for improving the legal mechanism for the prevention of crimes committing by public servants have been formulated. In particular, to unify the system of scientific and practical views on such a mechanism and create the only effective scientifically based concept of crime prevention in the sphere of public service, it is proposed to develop a Strategy for Public Service Sphere Protection until 2025, and for its implementation — the State Program for Civil Service Sphere Protection until 2025.
