APPLICATION OF CIVIL LAW STANDARDS IN PROCUREMENT CONTRACTS

In the publication within the general doctrine of civil law, an attempt was made to consider the procurement contract through the prism of civil law with parallels between the essential requirements of the contract contained in the Civil Code of Ukraine and the Law of Ukraine «On Public Procurement». The concepts of «contract», «procurement contract» are generally characterized and their special features that determine the relevance of the topic are identified. Attention is paid to the case law and the practice of the Antimonopoly Committee of Ukraine on violation of the essential terms of the procurement contract. The paper formulates conclusions that the procurement contract has special essential conditions based on the Civil Code of Ukraine.
