INTERNATIONAL (EUROPEAN) STANDARDS FOR EVALUATING THE WORK OF PROSECUTORS

The article reveals the features of assessing the work of prosecutors based on an analysis of international (European) legal norms and standards in the field of prosecutorial activities and the status of prosecutors. It is noted that in Ukraine, the legal basis for assessing the work of the prosecutor, next to international (European) standards, is the provision of the Law of Ukraine «On the Prosecutor's Office» and the provisions of the Strategy for Reforming the Judicial System, Judicial Proceedings and Related Legal Institutions for 2015- 2020. It is determined that the assessment of the work of prosecutors is carried out from the standpoint of the overall effectiveness of the prosecutor's office and from the standpoint of an individual approach, which determines the effectiveness of the work of an individual prosecutor. It has been proved that evaluating the work of the prosecutor from the standpoint of an individual approach allows determining the needs for professional development of the prosecutor, as well as establishing the level of productivity of his prosecutor's activities. It was established that the assessment of the work of the prosecutor should be carried out by a collegial approach, where the subjects of the assessment should be prosecutors of the prosecutor's office in which the prosecutor carries out prosecutorial activities and whose work is being evaluated, or prosecutors of another prosecutor's office. It is determined that evaluations of the prosecutor's work should be carried out in formal and informal ways, but formal evaluations of the work of the prosecutor may include informal evaluations, if necessary. It was found that the procedure for assessing the work of the prosecutor should be carried out on the basis of the same criteria (qualitative and quantitative) for one type of prosecutor's activity, which will characterize the professional, personal and social characteristics of the prosecutor's work. It has been proven that the process of evaluating the work of the prosecutor should be carried out regularly, constructively, using objective and adequate evaluation criteria and be impartial, fair and transparent. It is proposed that the prospects for further research in this direction identify priority areas for improving the work of prosecutors in Ukraine in order to increase the level of public confidence in the institution of the prosecutor's office as a whole.
