Abstract
When the parties agree on an obligation to each other, they assume their rights and obligations and conclude a contract between them. Over different periods, contracts have taken many different forms and types, of which electronic contracts are one of the new types. The increasing expansion of the Internet and the means of mass communication and the desire of communities to facilitate contractual matters, including sales, are among the main factors in the growth of this type of contract. The issue of the time and place in the formation of electronic contracts is also a new topic that has been further discussed and examined following this development. Benefiting from this type of contract also requires knowledge of basic and practical concepts. The question raised in this article is what is the role of time and place in the formation of electronic contracts? This article will respond to the question using a descriptive-analytical method. In view of the above, it should be said that electronic contracts are in fact an updated type of regular contracts with a different tool, because many of the elements accepted in contracts are also acceptable for electronic contracts..
