Normative legal acts regulation of distance learning in the open education system

Abstract

In the scientific investigation the analysis of normative-legal regulation of distance learning in higher education institutions of Ukraine is carried out. The main list of normative documents regulating the provision of higher education by distance learning is highlighted. The tendencies of normative-legal regulation development are described and the problematic issues that need to be solved both at the state and local levels, as well as at the level of administration of higher education institutions are identified. The ways of solving the outlined problems and possible directions of work norm improvement of scientific-pedagogical and pedagogical workers of higher education institutions who use a distance form of education. The absence of certain normative-legal acts regulating the remuneration of scientific-pedagogical and pedagogical workers in the conditions of distance learning is noted. After all, today the pay for distance and full-time education does not differ, and the cost of labour for the preparation of materials for classes in distance learning is much higher. The author proposes time norms for materials preparation and types of works performance in the conditions of distance learning, which are not provided by the current normative documents, which have not been revised since 2002. The difficult epidemiological situation related to the spread of COVID-19 has highlighted the problem, as educational institutions work in distance or mixed forms of education and research and teaching staff are faced with the problem of preparing and conducting online classes, online counselling and more. This requires some training, so teachers are constantly taught to use digital tools during the learning process. They independently develop materials and test them during classes independently. These are time-consuming types of work that were not taken into account and were not performed to such an extent during the full-time form of education. This article provides an opportunity to rethink the approaches to the remuneration of teachers, researchers and teaching staff working on a distance learning basis, and to make changes to the relevant regulations.
