MODELS OF «GREEN» TECHNOLOGY EXCHANGE: FOREIGN EXPERIENCE AND PECULIARITIES OF TECHNOLOGY TRANSFER IN UKRAINE

Abstract

The article is devoted to the study of mechanisms for the exchange of green technologies related to climate change, such as patent pools, patent communities, open licenses, public domain, open innovation, humanitarian or preferential licensing, as well as the transfer of green technologies and the specifics of license agreements. It is analyzed that the effective and timely development and transfer of green technologies is crucial for concerted global action to address climate change. It is determined that green innovative solutions are needed to implement the Sustainable Development Goals. The importance of the WIPO GREEN online platform for technology exchange, which supports global efforts to address climate change, is emphasized. The conclusion of technology transfer agreements is widespread in international practice. It is established that the transfer of «green» technologies is carried out through various agreements, the subject matter of which is technology transfer, and one of the practical solutions to facilitate the transfer of «green» technologies to developing countries may be agreed upon by issuing a license. When entering into agreements where the subject matter is the transfer of proprietary rights to technology or its components, it is recommended to identify the main points, namely: to determine the type of agreement on the disposal of intellectual property rights, and to provide for essential terms and conditions. It is determined that the transfer of «green» technologies or the granting of industrial property rights under license is regulated by various individually concluded agreements. The author analyzes that the state regulation in the field of technology transfer in Ukraine is carried out by the authorized body for the implementation of state policy and establishes the need to develop a Procedure for approving the transfer of technologies created or acquired for budgetary funds.
