Abstract

The article analyzes the history of development of legal regulation of solution of issues of establishment or change of subordination of settlements and other administrative-territorial units in the territory of Ukraine in the XX-early XXI century. It is considered practice of establishing or changing the subordination of territories by subjects of power on the example of administrative and economic units and other territorial units. It is argued that establishment and change of subordination of settlements, village, settlement, city councils and districts has not legally led to the transfer of their territories or change of their boundaries as administrative-territorial units, since these issues should be resolved by a separate procedure. It is emphasized that essence of decisions on establishment and change of subordination of territories is to determine or replace the subjective composition of the power legal relations between the governing bodies of administrative-territorial units. It is stated that such decisions may be a prerequisite for further fixing of the boundaries of administrative-territorial units under the procedure established by law. It is proved that in law enforcement activities, the decision to establish or change the subordination of territories may confirm the existence or absence of competence of the subjects of power to dispose of land.
