DETERMINATION OF MEASURES TO IMPROVE THE METHODOLOGICAL APPARATUS OF THE SYSTEM OF PREVENTION AND DETECTION OF CORRUPTION IN THE ARMED FORCES OF UKRAINE DURING A SPECIAL PERIOD

Abstract
The article focuses on the negative impact of corruption on the efficiency of the State mechanism, the reduction of the State's governability and the deterioration of the organisation of public life even under martial law. Prevention of corruption should be carried out exclusively on a legal basis — adhering to the principles of the rule of law and recognising that in Ukraine human rights and freedoms and their guarantees determine the content and direction of the State's activities. The author analyses the amendments and additions to the legislation on prevention of corruption in Ukraine during the period of martial law. It is stated that the novelties envisaged by the legislation on strengthening liability for corruption offences during martial law are fully justified and aimed at preventing the embezzlement of international assistance. A scientific vision of the legislative approach to preventing corruption in Ukraine has been developed. In addition, the Authorised Unit (authorised person) of the Agency for the Prevention and Detection of Corruption was introduced as the main part of the anti-corruption infrastructure designed to assist managers and other employees of public institutions, including during the period of martial law in Ukraine. The purpose of the article is to make a comparative analysis of the legal framework for measures aimed at improving the methodological apparatus of the system for preventing and detecting corruption in the Armed Forces of Ukraine during the special period. The author comes to the conclusion that during the special period, the following measures should be taken to improve and develop the system of prevention and detection of corruption in the Armed Forces of Ukraine Providing advice to declaration entities for the purpose of proper implementation of financial control requirements under martial law; providing methodological assistance to declarants holding military positions associated with a high level of corruption risks (brigadier general, lieutenant general, major general, general, vice admiral, rear admiral, admiral) in reporting significant changes in their property status; establishing an appropriate institutional system for preventing and detecting corruption in the Armed Forces of Ukraine based on international standards and best practices, taking into account the specifics of the Ukrainian legal system. An important step towards improving the institutional support system was the establishment of the Department for the Prevention and Detection of Corruption in the Armed Forces of Ukraine within the Ministry of Defence.
