LEGAL-ACTIVIZATION ASPECTS OF THE STATE-CREATING PATRIOTISM OF NATION UNDER THE MIGRATION POLICY UNDER THE CONDITIONS OF THE STATE OF MARTIAL

Abstract
The article emphasizes that the State migration policy is a comprehensive system of programmatic measures carried out under the legal and legislative auspices of the State to manage and regulate migration processes, based on the needs for legal and material protection of migrants' rights and creation of appropriate conditions for them to realize their own intellectual and labor potential, based on the principles of protection of national interests, security and territorial integrity. It is highlighted that the state-creative patriotism of nation (SCPN) is everything that the people in general and each citizen in particular do in the interests of creating an independent, sovereign, civilized state. It has been substantiated that with an open and balanced migration policy, when the state actively accepts foreigners and provides them with opportunities for successful integration, national unity and SCPN are strengthened. A civilized migration policy can testify to the state's openness, tolerance and interest in intercultural dialogue and the development of a multinational community, thus providing the logic of the manifestation of legal and activation aspects of the process. It is noted that in the conditions of martial law, the migration policy of the state should be directed to the legal aspects of ensuring the safety and well-being of its citizens, which, in turn, can influence their state-building motives, effectively encourage them to intensify their manifestation of SCPN. The application of programmatic socio-economic approaches and measures, provision of timely support and protection to citizens are important for receiving civilized wages, increasing labor productivity and strengthening their patriotic feelings and the corresponding consequent desire to stay in their native state, effectively manifesting at the levels: state-community-citizens, migrants. It was emphasized that it is expedient to develop reintegration programs for those who have already emigrated. In particular, legal interventions may include financial support, job and business opportunities, and social rehabilitation for those affected by war. It has been proven that the legal and activation aspects of the SCPN under the conditions of martial law due to the migration policy also have a tangible pragmatic component, as they allow to reduce the level of the shadow economy, which means that much more financial resources will fall into the state coffers, providing additional opportunities for strengthening the defense capability and support victims of hostilities. Yes, a change of only 1% in the level of the shadow economy in Ukraine is an additional 5.5 billion UAH in revenues to the budget.
