THE RIGHT TO EUTHANASIA: PROSPECTS AND APPROPRIATENESS OF LEGALIZATION

Abstract

The article is devoted to the coverage of one of the current theoretical and methodological issues of criminal procedural law regarding the expediency and prospects of legalization of euthanasia in Ukraine. The issue of legalization of euthanasia will be of great concern to humanity until a cure for all existing diseases is created. Given the dynamics of the emergence of an increasing number of new diseases in the world and mutational processes in relation to existing ones, it will require a lot of effort and time of scientists from different countries, so at this stage, it is necessary to take care of existing patients who suffer from incurable diseases or are at a stage when it is too late to do anything, and it is considered appropriate to take into account the desire of such people to end their own suffering, which will inevitably accompany them until the moment of biological death. This article analyzes the legislative framework in order to evaluate the possibility of legalizing euthanasia. It is established that at the moment the legislation clearly prohibits active and passive euthanasia and has serious sanctions in case of non-compliance with the law, especially in the case of medical professionals. The authors analyze the necessity of the right to death, taking into account the problems due to which in certain cases it is too late to cure the disease and a person has to endure physical and emotional suffering while waiting for the moment when his or her body ceases to function. The authors pointed out the possibility of applying palliative care to such persons, which should improve the quality of life of the patient and help him or her to relieve pain and other symptoms that may cause anxiety, as well as provide psychological assistance and support to both the person and his or her relatives. Examples of countries that have legislated the possibility of euthanasia to end human suffering were also given, and the criteria they have created for a person to be able to use this option were analyzed. In addition, the article raises the issue of the need to develop clear rules that would regulate the process of admitting persons to euthanasia and provides examples of the principles on which this type of ending suffering could be based.
