Protection and Preservation of Audiovisual Heritage According to the Regulatory and Legal Documents of the Council of Europe and the European Union

Abstract
The purpose of the work is to analyze the solution to the problems of protection and preservation of audiovisual heritage according to the normative legal documents of the Council of Europe and the European Union (EU). To realize the goal, the status, powers, goals, spheres of activity, peculiarities of the legal system of the Council of Europe and the EU, their role in the processes of European integration are considered. The main attention is paid to the examination of six conventions of the Council of Europe and a number of secondary acts adopted by the governing institutions of the EU, which recorded the key directions and content of their cultural policy, the significant increase in the role of culture in the system of integration strategies and the formation of a single European cultural space, the peculiarities of the legal regulation of social relations in the sphere cultural heritage, as well as audiovisual heritage. The chronological boundaries of the elaborated conventions of the Council of Europe cover 1954–2017, secondary acts of EU law – the beginning of the 2000s – 2021. The methodology of researching the issues of the article includes: general scientific (historical, logical, systemic, structural-functional) and special scientific (definitive analysis, historical-legal, comparative-legal, source analysis and synthesis) methods, the terminological apparatus of international law, the rights of the Council of Europe and EU, theories of public administration. The scientific novelty, taking into account the limited research in Ukrainian archival studies of the mentioned topic, consists in the comprehensive coverage of the European experience of regulatory and legal protection and preservation of cultural heritage, and its component – audiovisual heritage. The conclusions justify the need to study this experience and adapt it to solving the problems of development of the state archival business. Attention is focused on the proposals of domestic scientists regarding the improvement, taking into account international and European approaches, of the security principles of the state policy of protection and protection of cultural heritage in the conditions of armed aggression of the Russian Federation against Ukraine.
