COMPENSATION OF DAMAGES AS A FORM OF ECONOMIC AND LEGAL LIABILITY IN THE FIELD OF ENERGY DURING THE PERIOD OF MARITAL STATE IN UKRAINE

Introduction. The article analyses the current state of research on compensation for damages as a form of economic and legal responsibility, in general and in the field of energy separately, the specifics of the application of this form of economic and legal responsibility specifically in the field of energy, the existing problematic issues of its application, and proposals for their application are given settlement. The role of a permanent central body of executive power with a special status in regulating issues of compensation for losses in the field of energy has been studied. Ways to improve regulatory and law-enforcement regulation of damages in the field of energy, relevant research and development are proposed. The purpose of the article is: to identify regularities, essential features in the application of such a form of economic and legal responsibility as compensation for damages; defining the features of this form of responsibility in the field of energy, revealing the grounds, main features, differences between damages and other forms of responsibility defined and applied in the field of energy, in the modern conditions of its existence after the creation of energy markets in Ukraine (natural gas and electricity markets), as well as the specifics of compensation for damages caused by the full-scale invasion of the Russian Federation in Ukraine, both in the field of energy and in general. Materials and methods: the research materials are: 1) regulatory and legal acts that determine the grounds for applying such a form of economic and legal responsibility as compensation for damages 2) works of domestic and foreign authors conducting their scientific and practical research in the field of economic and legal liability 3) practice of domestic courts. In the process of carrying out the research, the following scientific methods were used: theoretical generalization and grouping; formalization, analysis, and synthesis; logical generalization of results (formulation of conclusions). Results: the scientific article revealed the main regularities in the application of such a form of liability as compensation for losses in general and in the field of energy, revealed the grounds, main features, compensation for losses in the field of energy, gave examples of the application of such grounds to business entities. Prospects: in further scientific research, it is proposed to focus attention on practical recommendations, the implementation of which will allow for efficient and quick compensation of losses to energy market participants, to form a legal basis for compensating energy market participants for losses caused because of hostilities.
