THE PHENOMENON OF LEGAL INDIFFERENCE IN THE SOCIAL SPACE: APPARATUS AND DIRECTIONS OF CONSIDERATION FROM THE POSITION OF STATE-CREATING PATRIOTISM OF NATION

For the first time, it was synthesized and substantiated that the phenomenon of legal indifference is associated with the lack of any interest, attention or responsibility in taking into account the existing legal provisions or norms in the specific context of the activity of a person (people) in the public space, thus causing the ignoring of traditional universal values, a decrease in efficiency the mechanism of formation and functioning of state formation and limiting the manifestation of the motivational stability of human (or collective) relationships. An instrumental apparatus was proposed and developed for the integral assessment of the level of manifestation of the phenomenon of legal indifference from the standpoint of state-creating patriotism of nation based on taking into account constitutional principles, basic laws, legal norms and rights of citizens and their direct participation in civil life. It is emphasized that it is advisable to combine assessment methods to obtain a comprehensive picture of the level of manifestation of legal indifference. A hypothesis was synthesized: the manifestation of the phenomenon of legal indifference in the public space has a cumulative effect in dynamics, compared to human empathy or responsibility for one another, which can gradually transform into this phenomenon over a long period of time or consideration of a territorially distant object of observation. It is substantiated that the discovery of this phenomenon has a wide range of manifestations in various scientific areas of social and humanitarian direction (law, state-creating, economics, philosophy, psychology, sociology, education, military affairs, diplomacy, medicine, history, management, etc.) that relate to the behavior of people and their decision-making in specific situations. It is emphasized that the fundamental problem of the manifestation of the phenomenon of legal indifference should be purposefully considered both in the legislative field of Ukraine and international law. It is emphasized that attention to the phenomenon of law-wing indifference, in addition to purely rational legal aspects, also has a pragmatic side, that is, a specific financial dimension. Thus, a change of only 1% of the level of the shadow economy of the world, due to purposeful limitation and avoidance of the manifestation of the phenomenon of legal indifference, will additionally allow to receive up to 100 billion US dollars in tax revenues for state budgets.
