STRATEGIES FOR SETTLEMENT OF CURRENT ISSUES ON ENSURING LABOR SAFETY IN MARITIME TRANSPORT

Abstract

Introduction. The strategies for the settlement of urgent issues of labor protection in maritime transport include a set of measures and legal mechanisms to ensure the safety and health of seafarers and other workers in this field. They are based on the analysis of the peculiarities of maritime transport, its working conditions and the risks associated with them. National legislation is of decisive importance in the regulation of occupational health and safety issues on ships, because it determines the rights and obligations of participants in maritime transport and the mechanisms of their protection. However, international cooperation and coordination with the standards and regulations of the International Maritime Organization (IMO) and other relevant international organizations are also necessary to address many aspects of occupational health and safety in maritime transport. Purpose. The purpose of the article is a comprehensive study of the strategy for the settlement of current issues related to occupational health and safety in maritime transport, the definition of legal acts and their impact on the regulation of occupational health and safety in maritime transport, as well as the peculiarities of the adaptation of Ukrainian legislation in the field of occupational health and safety to European and international standards. Materials and methods. The research materials are: 1) regulatory and legal support for the regulation of occupational health and safety in maritime transport, including international conventions, domestic laws and by-laws; 2) works of domestic and foreign authors conducting scientific and practical research in the field of labor protection and safety in maritime transport. In the process of conducting the research, the following scientific methods were used: theoretical generalization and grouping — to characterize the components of the labor protection system on sea transport and functions related to ensuring labor safety (this method helped to identify the main problems in the field of labor protection and the risks associated with with work on sea transport); the method of formalization, analysis and synthesis (used for the study of domestic and international legislation, their adaptation to effectively overcome issues of labor protection in maritime transport); comparative analysis (to compare different approaches to labor protection in maritime transport in different countries). logical summarization of the results (for formulating conclusions and developing recommendations for improving labor protection in maritime transport); this method helped to integrate the results of analysis and synthesis into a single concept that takes into account all aspects of labor protection. Results. The scientific article revealed the problems of labor protection in maritime transport and the need to create a safe environment for workers who work in such specific conditions. The causes of the threat to the safety of shipping and the entire crew have been identified. Basic legal acts regulating the professional activity of seafarers have been established. The role of conventions and agreements in the field of labor protection in maritime transport is considered. An analysis of domestic developments in the field of labor protection in maritime transport was made, and the need to adapt domestic legislation to international standards was revealed. It was established that the main reason for the ineffectiveness of the labor protection system in Ukraine is non-compliance with European and international standards, as well as the lack of adaptation of domestic legislation to international acts in the field of labor protection in maritime transport.
