Abstract

The article, based on the current legislation of Ukraine and regulatory legal acts of the European Union, examines the legal basis of electronic identification in Ukraine. The object of the study is public relations related to the legal provision of identification in Ukraine in the context of digital transformation. The subject of the study is a set of legal acts of Ukraine and the EU on identification and the status of theoretical research in this area. The methodological basis was a system of general scientific and private law methods: analysis and synthesis, abstraction and modeling, observation, generalization, description, classification, etc. The system-forming role of legal support for electronic identification in the system of information law as a public legal branch in the context of the development of the information and communication space is substantiated. It has been proven that legal support for electronic (digital) personal identification is an integral part of the information security of Ukraine. The key role in the formation and implementation of policy in the field of information and communication technologies on electronic (digital) identification based on digital platforms and the Unified web portal of electronic services is substantiated. It is noted that the development of the national electronic (digital) identification system at the present stage is determined by a combination of factors for: the growth of the use of digital technologies; principles and strategic directions of state policy in the information sphere; dialectics and multi-level electronic identification; priority of using public legal means; overcoming fragmentation in the applied organizational and legal measures; the strategic importance of electronic (digital) identification in the context of the European integration of the state; legal problems of regulating public relations related to the development and implementation of digital technologies in the field of electronic (digital) identification.
