Abstract
Introduction. This article examines the issues related to the concept of criminal offenсes in the field of land relations, their classification, and the identification of problematic aspects of regulatory and legal support and protection of land relations from criminal offenсes. Purpose. The purpose of the article is to provide a comprehensive analysis of the concept of criminal offenсes in the field of land relations, and also to identify the problematic aspects of regulatory and legal support and implementation of legal mechanisms for protection against criminal offenсes. Materials and methods. The research was based on the legislative acts of Ukraine, including the Land Code of Ukraine and the Criminal Code of Ukraine. The study used the methods of system analysis, comparative legal method and method of generalization. Results. The study shows that the high value of land makes it attractive and creates the basis for criminal offenсes in the field of land relations, which are quite common today. In the field of land relations, crime is expressed in a wide range of criminal acts occurring in this area. The specificity of criminal offenсes in the field of land relations is that, as a rule, they contain a self-interested, economic, and ecological component; in the actions of persons committing criminal offences often signs of corruption, which in turn leads to negative consequences for the field of land relations. It is proved that the lack of a clear theoretical understanding of the concept of criminal offences in the field of land relations of Ukraine, and their classification does not allow to outline the range of socially dangerous acts which fall under the criminal law provisions which are the object of land relations, and the placement of legal provisions providing for criminal liability in the field of land relations in different sections of the Criminal Code of Ukraine increases the conflict of criminal law, which complicates and in some cases makes it impossible to apply. Discussion. The problem of criminal offences in the field of land relations requires a comprehensive legal analysis, and in further research it is suggested to focus on the preparation of scientifically sound recommendations for amendments to the current criminal legislation, which should act as an effective mechanism for ensuring the rational use and protection of land, as well as preventing criminal offences in the field of land relations.
