TYPES OF THE INNOVATIVE LABOUR SUBJECTS AND LEGAL MECHANISMS FOR THEIR ACTIVITIES UNDER THE LAWS UKRAINE

The article is devoted to the subjects of the innovative labour. It have been defi ned the subjects of the innovative labor and offered legal criteria for their selection. The author defi nes innovative labour as an employment of certain categories of employees (academic staff, production staff of innovative enterprises), the object of which is to create an innovation that is the design, implementation in production and sale of innovative products. It is inseparable from its carrier, has an individual, subjective and largely creative character. It is labour, which in addition to regulated labour component contains innovative component that turns it into a new type of work ? the innovative labour. The author describes the follow features of the innovative labour: creative character, innovative activities, subjective, individual character, and low risk nature of the predicted outcome. According to the article it can be offered follow criteria for assigning to innovative employees: implementation of enterprise innovation activities in the priority areas of innovation activities; more than 70 per cent of its activities (in monetary terms) for the reporting tax period is innovative products and (or) innovative products; workers labour function is to create innovation ? the development, implementation in the production and sale of innovative products. Much attention is given to the procedures for evaluation and certifi cation of innovative employees. The procedures for certifi cation and evaluation of employees working on innovative enterprises should be fi xed as the legislative and local levels of regulation. It has proposed to develop and adopt a Regulation on certifi cation of employees of innovative enterprises.
