The Effect of Punishment in the Islamic Legal Provisions

Abstract

God had ordered mankind of things made it obligatory for them to comply with them, told them about things that are forbidden for them to do, and specified sanctions on committing any of these prohibitions. These sanctions are either “collective punishment”, like the punishments of the “nations” who disbelieved “their own” prophets, or “Individual sanctions” for only those who violate His orders and prohibitions and not others. To implement these sanctions or “default judgment” on the impact of the subsequent actions of the sanctions, such as the fulfillment of purity (Tahara) if the water used is from the wells of those who have been punished by God , and its impact on and the correctness of prayers in such places. In addition, in some cases, the punishment affects the entitlement for new punishment when a punishable offense is repeated, and in some other cases, the sanctions will be dropped, or a different sanction will be applied when a punishable offense is repeated. Through this research I have addressed the impact of the sanction in all those cases, and covered the worshipping and the non- worshipping situations, and addressed the general scholars agreement and disagreement on theses sanctions, and then summarized the “most approved”opinion of them.
