PRESENT STATUS AND SYSTEM IMPROVEMENT OF INVESTIGATION JURISDICTION INTO CRIME OF CHINESE CORRUPTION

The China’s government is always highly focusing on work of anti-corruption and plenty of corruption civil servants are investigated and punished not in the place where the crime is committed, which exhibits spirit of getting rid of any corruption. The jurisdition of corruption crime is different from that of common crime, which is determined by its special characteristics. However, there is no definite regulation to designated investigation jurisdiction in China’s law, so there are improper issues of no definite lawful standard, random empowerment by itself and inappropriate prosecution when investigating criminal in practice. This article illustrates jurisdiction of our country’s corruption crime from levels of legal ground and practical case and provides correspondent improvement advices according to reflection to present status and practical circumstance, with a view to benefit the establishment of crime investigation and jurisdiction system on the legislation.
