Abstract
The article analyzes the problem of legal regulation of the service contract, the definition of a service contract in the Civil Service in the Russian Federation. The author explores the concept of "public servant" and "civil servant". He identifies signs of concepts and concludes that the second side of the service contract is only a civil servant.
