COMPARATIVE CHARACTERISTICS OF THE INSTITUTE OF HARMFUL AGREEMENT IN EUROPEAN AND NATIONAL LEGISLATION

The article deals with the main provisions of the legislative regulation of the inheritance agreement in European and national law, defines the main features of the German and Latvian models of the inheritance agreement, defines the notion of inheritance agreement under the civil law of Ukraine. It is noted that the Ukrainian legislation on the inheritance agreement has many similarities with the European one and its differences. It is determined that in the Civil Code of Ukraine the most protected interests of the heir, who concluded the inheritance agreement with the decedent, in contrast to the considered German and Latvian model of the inheritance agreement.
