FEATURES PRE-TRIAL INVESTIGATION ON AIR, SEA OR RIVER VESSELS WHICH ARE OUTSIDE UKRAINE WITH THE FLAG OR MARKINGS UKRAINE IF VESSEL ASSIGNED TO THE PORTS LOCATED IN UKRAINE

The article is devoted to the study of the general provisions for conducting a pre-trial investigation, namely, by air, sea or river vessels in the event of a criminal offense. We consider the question of the persons who are authorized to conduct a pre-trial investigation in such cases, namely, the captain or another member of the crew authorized to do so. Clarifies the procedure for the application of measures to ensure criminal proceedings by an official in cases of a criminal offense in air, sea or river vessels. The author compares the regulation of conducting a pre-trial investigation in various laws and by-laws of Ukraine. The article analyzes the normative regulation of conducting a pre-trial investigation on a sea or river vessel of Ukraine, which is located outside Ukraine under the flag or with an identification mark of Ukraine, if this vessel is assigned to a port located in Ukraine, the Criminal Procedure Code of Ukraine and the Procedure Instructions for Procedural Actions in the course of criminal proceedings on a sea or river vessel of Ukraine, which is outside of Ukraine, under the flag or with the identification mark of Ukraine, if this vessel is Sano to the port located in Ukraine.
