Abstract

The incidents of accidents during sporting events are inevitable. Some of these events can cause serious injury to athletes, spectators or handicaps, and even in some cases their deaths. Every incident has a cause, and the cause can be the fault. In many cases, the failure of coaches, teachers, or athletic directors to perform a task that can be a major liability for athletic law is the cause of the accident. Sports coaches are responsible for training and practicing athletes with a variety of legal responsibilities in the field of sports, but today it is not accepted that anyone participating in sports must accept the risks involved. Of course, some sports are traumatic in themselves and the participating athlete should expect some injuries while doing so, but the question is whether athletes and spectators come to the gym to become disabled or have bone fractures or Will they die? The answer to the question is clear, no one expects that, and if the athlete is harmed by the failure of a responsible person, the partnership should be held accountable. Given that there are some immoral problems in the world of sports such as violence, cheating, etc., many countries have been planning and compiling laws and regulations in this area. Article 158 of the Islamic Penal Code of 2013 has eliminated criminal liability for accidents resulting from sporting activities. However, the state of civil liability arising therefrom is not clear. Considering our legal system and legal process based on Islamic jurisprudence rules, it is necessary to conduct a comprehensive study of the grounds of civil liability of athletes for this basis. Provide a suitable basis for the regulation.
