CRIMINOGENIC DETERMINANTS OF OFFERING, PROMISING OR PROVIDING UNLAWFUL ADVANTAGE TO THE CIVIL SERVANT IN UKRAINE

Abstract

The article deals with a complex analysis of criminogenic determinants that lead to committing a crime of offering, promising or providing unlawful advantage to the civil servant in Ukraine, as well as facilitate its spreading. In particular, the author has analyzed and classified the reasons, conditions and factors of this crime which is punishable according to Article 369 of the Criminal Code of Ukraine. It is stated that the reasons for the crime of offering, promising or providing unlawful advantage to the civil servant in Ukraine originate from the state policy, social life, culture and bureaucratic traditions common for the country. Detailed analysis of scientific sources has made it possible to single out the following types of criminogenic determinants of this crime according to essential characteristics: economic, political, social and psychological, cultural and educational and legal. It is also stated that Ukraine is one of the countries where criminality of offering, promising or providing unlawful advantage to the civil servant has a great tendency to increase. It is noted that during 2015–2018 the number of registered crimes by Article 369 of the Criminal Code of Ukraine has tripled. It has been defined that the reasons for increasing of this type of crime were critical phenomena in economic, social, political, psychological, organizational and other spheres. The author concludes that one of the key reasons leading to this crime in Ukraine is the lack of negative attitude to this problem in Ukrainian society and the tradition of expressing gratitude to civil servants for solving citizens' problems which is ingrained in the consciousness of people. Moreover, the most important reasons and conditions of committing the crime of offering, promising or providing unlawful advantage to the civil servant have been generalized in this article. The author also states which preventive measures should be taken to stop this crime in the future.
