Basis for the establishment of the joint property right of the spouses

The paper notes that the legal relationship between spouses regarding common property is a rather complex and multifaceted issue. The analysis of scientific literature, family legislation of the Donetsk People's Republic, the Russian Federation and Ukraine made it possible to determine the following grounds for the emergence of the joint property right of spouses, namely: officially registered marriage, cohabitation, joint work of spouses on the acquisition of joint property. The paper also examines the common law marriages (concubinage), their legislative consolidation in the Family Codes of the Russian Federation and Ukraine, and consequently offers the suggestions on improvement of the current family legislation of the Donetsk People's Republic.
