CONCEPTUAL MODEL OF ADVERSARY CRIMINAL PROCEDURE AT THE STAGE OF PRE-TRIAL PROCEDURE IN THE REPUBLIC OF KAZAKHSTAN

The urgent character of the article is determined by the necessity of controversy principle expansion in Kazakh criminal procedure. Democratic processes and precedence of personal rights over the state in Kazakhstan predetermine the consequent rejection of former formalism and prosecutorial bias in the activity of organs dealing with criminal case. The evaluation of law enforcement practice in the sphere of criminally remedial relations is necessary. According to the results, the necessary recommendations will be created. Thus, acceptance of the mentioned suggestions by legislators will allow implementing adversary method of legal regulation into criminal law and transforming Kazakh mixed criminal procedure into adversary one.
