HUDUD AND ISTILAH LITERATURE IN ISLAMIC LAW LITERATURE / İSLAM HUKUKUNDA HUDÛD VE ISTILAH EDEBİYATI

Abstract

That people have comprehensive knowledge of their field, qualification and competency could be understood to some extent by using these terms correctly and appropriately. There are hudud, ıstılah and description books written as a literary genre in Islamic history. These works deserve the interest in terms of guiding to those concerned in their own fields and displaying a seperate field at a level of specialization. Out of the literature studies, resources and references, firstly the books that editors who are members of Hanefi sect wrote about description and especially the the books including islamic law were determined, introduced and examined chronologically. In the history of Islamic law, some works having fıqh technical terms and their authors which we have identified are as follows: 1. Ez-Zineti fi'l-kelimati'l-islamiyyeti'l-arabiyye/Ahmed b. Hamdan er-Razi (died- 322/933). 2. Mefâtîhu'l-ulûm/Muhammed b. Ahmed el-Havârizmî (died. 387/997). 3. Hilyetü'1-fukahâ/ Ahmed b. Faris (died. 395/1004). The subjects are taharat (cleanliness) , salât (Prayer),buying and selling. It contains lexical and etymological explanations of Fıqh terms. 4. El-Hudûd fi'l-usûl/Muhammed b. Hasan İbn Fûrek (died. 404/1015). There are 133 technical terms regarding fıqh and kalam. 5. Risale fi'l-hudûd/Süleyman b. Halef el-Bâcî, (died. 474 /1081). 6. Tılbetu't-tâlibeti fi'l-lügati alâ elfâzi kütübi fıkhi'l- hanefîyye/Ömer b. Muhammed en-Nesefî,(died. 537/1142). It is a dictionary of technical terms of fıqh. I t begins with taharah and finishes with istihlaf ( designation a successor) and tezkiye (examining reliability of a witness) 7. Risaletü'l-hudûd/Mes'ud b. Ömer et-Teftâzânî (died. 792/1390). Concepts regarding methodology of fıqh are frequently described in the book. 8. Târifât/Ali b. Muhammed Cürcânî (died. 816/ 1413). Important concepts in philosophy, mantık (logic), hadith and fıqh were contained in the work that was prepared alphabetically. 9. el-Hudûd ve'l-ahkâm/Ali b. Muhammed el-Musannifek (died. 875/1470). 10. Seyfu'l-kudât ale'l-bugât/Muhammed b. Süleyman el- Kâfici (died. 879/1474). It contains jurisdictional procedures and terms....
