PROBLEMS OF QUALIFICATION OF OBSTRUCTION OF LAWFUL PROFESSIONAL ACTIVITY OF JOURNALISTS

The article deals with the main problems of the qualification of the crime provided for in Article 144 of the Criminal Code of the Russian Federation (Obstruction of the lawful professional activity of journalists). The notion of professional activity of journalists is disclosed, as well as difficulties in determining the victim of this crime. In addition, signs of lawful activity of journalists, which are based on the Federal Law "On Mass Media", are considered. The problematic question of the way of exposition of the norm is raised, which complicates its practical application. The purpose of writing a publication is to identify and explain the reasons for the difficulty of applying this rule to practice. The article in question remains among the few in demand in criminal law, the application of this criminal rule should become more suitable for practical use. To do this, it is necessary to clearly define the limits of the professional rights of journalists.
