THE REVIEW OF THE LEGISLATION AND LEGAL POSITIONS CONCERNING TO LIMITATION INSTITUTE OF RIGHT AND PERSON'S FREEDOM (BY THE EXAMPLE OF ACTION OF STATE OF EMERGENCY)

In the article overview of the legislation of Russian Federation was made concerning to limitation of right and person's freedom. As example more of sophisticated analysis of such institute the mode of state of emergency was taken. Various points of view were analysed concerning to given problems. By comparison of the Constitution of the Russian Federation and European convention on human rights those grounds were shown which can serve for abuse of right to limitation of right and person's freedom.
