FORMATION OF SUBJECT LABOR COMPANY LABOR LAW

In the article deals with the views of scientists, for the recognition of the subjects of labor law by members of social relations, who possess the rights established by the law, fulfill their obligations and bear responsibility. The subject of labor law begins to be the subject of labor relations at a time when he has the opportunity to participate in the legal relationship in fact. Labor relations are a form of social relations that arose in the field of human labor in social production due to the existence of legal norms adopted by the state for their regulation. A valuable approach to the classification of the subjects of labor law, from which all the entities, including the state and its bodies, are formed, are formed. The qualification of the subjects of labor law is important, since it provides an opportunity to describe and differentiate their most important characteristics in a more diverse way. The term "employee" is investigated, in turn an employee may be a person who has already started working or is in a search. It is the employee who is the bearer of labor, the labor same legal relationship serves as the legal mediation of his labor activity. The legal status of an employee becomes a person after the conclusion of an employment contract (contract). That is, an employee is an individual who has legal capacity and entered into a legal relationship with the employer. The proposal to introduce into the new Labor Code of Ukraine a section devoted to the subjects of labor law is considered, therefore the new Labor Code of Ukraine should systematize in a single whole all norms and principles of labor law, both Ukrainian and international, all general and universal norms of this legal branch.
