The spiritual foundations of the constitutional system of Ukraine

Abstract
This article describes the legal dimension of the concept “the spiritual foundations of the constitutional order”. It holds that spiritual foundations is an integral part of the constitutional order, which is a reflection of the whole system of fundamental principles of the legal status of a person, of his/her spiritual life, of moral consciousness proclaimed in the Constitution of Ukraine and protected by the state. Spirituality as a person's need for realization of his/her interests in the field of science, art, education, culture, and religion finds its legal expression in the relevant articles of the Constitution (first of all, in the Preamble and Chapter I), in particular in the principles of ideological and political diversity, freedom of opinion and religion proclaimed by it. Particular attention is paid to the principle of ideological and political diversity. It is noted that ideology is a higher level of social consciousness, which actively influences all forms and directions of activity of people. The article maintains the expediency of conducting researches on creation of integration (unifying) ideology. Its nucleus should be a set of social values such as human honor and dignity, social justice, spirituality and integrity, love for the Motherland. The article claims that in a democracy and political freedom, no group of individuals or professional communities can establish a monopoly on propaganda or the right to be the only bearer of social values. The article also considers the concept of secular state and freedom of conscience as an integral part of the spiritual foundations of the constitutional order of the state. The conclusion is made on the necessity of using this legal construct in the modern educational and scientific space of Ukraine.
