Abstract
The article is devoted to study of problems of access of an attorney to participate in criminal proceedings. Approaches to the definition of documents that certify the powers of an attorney in criminal proceedings, and the latest legal positions of the Supreme Court of this issue, were analyzed. Particular attention is paid to cases of violation by the bodies of preliminary investigation of the requirements, relating to the access of an attorney to participate in criminal proceedings and to the procedural effects of such violations.
