Abstract

This article is devoted to rethinking the classical concept of the rule of law, analyzing the features of the rule of law, the main problems of its development in democratic and undemocratic states, inaccuracies in the subordination of the state to society, the views of all scientists, from the birth of this concept to the present day, parallels between the national legislation of Ukraine and international acts on this issue. So, the rule of law is a new stage in the establishment and development of statehood. It should be regarded as a certain result of historical development and as the achievement of universal human culture. Such a type of state should not only proclaim the rights and freedoms of a person, but also create a ramified mechanism for their protection. It is also important that the rule of law can not be proclaimed - it should be formed as a result of the reforms of economic, political, state and legal institutions, a real change in the nature of the relationship between civil society, state and personality.
