PROBLEMATIC ISSUES OF DETERMINATION OF THE LEGAL FORCE OF THE DECISIONS OF THE COURT OF JUSTICE OF THE EUROPEAN UNION

The authors considered the problem of determining the legal nature of the decisions of the European Court of Justice of the European Union in the article. The doctrinal approaches to addressing the need for compliance with the decisions of the Court, as well as the attitude of the court to the binding nature of its own decisions are analyzed. The author pointed to the need for the normative fixing in the constituent agreements the legal force of decisions of the Court of Justice.
